Conclusion of a contract:

By booking a service or a voucher, a contract is concluded between the customer and Pullout Skydive GmbH. This contract is based on these general terms and conditions of participation and business. By registering, you bindingly accept these terms and conditions.

Tandem jumps:

Registration for all tandem jumps is done by phone or email. With the reservation, Pullout Skydive GmbH can request a deposit of €50. The reservation is only binding after receipt of the deposit. Remaining payments are possible on site in cash or with EC card. Due to weather conditions, there is unfortunately always the possibility that delays may occur or the existing appointment may have to be postponed. Should this be the case, you can arrange a new appointment free of charge. If a tandem jump is canceled at short notice due to circumstances for which Pullout Skydive GmbH is not responsible, due to bad weather conditions, there are no claims for compensation against Pullout Skydive GmbH

Vouchers:

All vouchers from Pullout Skydive GmbH are value vouchers, which are only provided as examples and for illustration purposes with the description of a specific service (for example, “tandem jump”). These value vouchers can generally be credited to all offers from Pullout Skydive GmbH. In no case will amounts paid be refunded for vouchers purchased and paid for.
The claim to redeem a voucher from Pullout Skydive GmbH is subject to the statutory limitation period of 3 years. The claim to redeem vouchers arises with the date of issue, unless otherwise stated on the voucher. If a voucher is not redeemed within the validity period, it expires without replacement and without any claim for reimbursement of the amount paid. The vouchers are transferable, Pullout Skydive GmbH requires to be informed of any transfer of the voucher. However, Pullout Skydive GmbH can object to a transfer if there are reasons in the person of the transferee that prevent redemption by this person. The jumping season is from April 1st to October 31st of each year. The voucher can only be redeemed during this time. The voucher can only be redeemed on a previously agreed date. The customer is responsible for arranging the appointment in good time. Places are limited for each appointment. Pullout Skydive GmbH is not obliged to comply with a customer’s desired date. Even with agreed appointments, there may be waiting times.
Pullout Skydive GmbH can interrupt jumping operations at any time for safety reasons. In this case, a new appointment must be made with the customer in accordance with the above conditions.
Pullout Skydive GmbH reserves the right to withdraw from the contract or, if such a change occurs later than four months after the conclusion of the contract, to demand reasonable participation of the customer in the costs in the event of unforeseeable and significant changes in the price calculation, in particular tax rates, tax bases, insurance contributions, fuel prices or official requirements.

Cancellation:

The customer’s cancellation of an agreed appointment is possible free of charge, provided that it takes place at least 7 days before the agreed appointment. If a customer cancels less than 7 days before the agreed appointment, Pullout Skydive GmbH will charge a cancellation fee of €100 (including the currently valid VAT). For agency customers, the voucher expires and will be settled with the respective agency.

In the event of no-show for the agreed appointment, vouchers from agencies as well as Pullout Skydive GmbH itself will be charged in full.
If a voucher is not redeemed within the validity period, it expires without replacement and without any claim for reimbursement of the amount paid.

Insurance:

Insurance is taken out during the jump as follows:

Liability and accident insurance for the aircraft used to cover
third-party damage
Liability and passenger liability insurance for the tandem jump systems used

The participant is responsible for additional insurance cover. In the case of privately concluded life or accident insurance policies, you should ask the insurer to what extent air sports are included.

Disclaimer:

The participant waives all claims against Pullout Skydive GmbH or the persons or institutions involved in the tandem jump that he suffers from his activities in aviation, through the operation of the aircraft, his stay on the airfield premises and through other aviation equipment, through accidents or other disadvantages, unless they are based on gross negligence or intent. This does not apply in the event that the damage results from injury to life, body or health.

Liability of the participant:

In the event of intentional or grossly negligent damage to jumping equipment, the person who caused the damage is liable. Contamination of the tandem system by bodily fluids will be charged according to the cleaning effort. Tandem passengers can be excluded from performing a tandem jump if they endanger their own safety or the safety of others or disrupt the jumping operation in a sustainable manner (there is no claim for reimbursement here). Our price list is subject to change. However, all offers are generally charged at the price valid on the day of booking.
Conditions of participation for parachute sports training:
The conditions of participation for training courses at Pullout Skydive GmbH can be found in the leaflet provided under “Forms”.

Revocation:

You can revoke your contract declaration within two weeks without giving reasons in text form (letter) and by returning the item (vouchers). The period begins at the earliest with receipt of this notification. To meet the cancellation deadline, it is sufficient to send the cancellation or the item in good time.

Consequences of revocation:

In the event of an effective revocation, the services received by both parties must be returned and any benefits derived (e.g. interest) must be surrendered. If you are unable to return the received service in whole or in part or only in a deteriorated condition, you may have to compensate us for the loss in value. In the case of the transfer of items, this does not apply if the deterioration of the item is exclusively due to its inspection – as would have been possible for you in a retail store, for example. In addition, you can avoid the obligation to pay compensation by not using the item as an owner and refraining from anything that impairs its value.

Choice of law & place of jurisdiction:

The contractual relationship between the provider and the customer is subject to the law of the Federal Republic of Germany. Excluded from this choice of law are the mandatory consumer protection provisions of the country in which the customer has his habitual residence. The application of the UN Convention on Contracts for the International Sale of Goods is excluded.
The place of jurisdiction for all disputes arising from the contractual relationship between the customer and the provider is the registered office of the provider, provided that the customer is a merchant, a legal entity under public law or a special fund under public law.

Severability clause:

Should a provision of these General Terms and Conditions be invalid, this shall not affect the validity of the remaining provisions.
